Problem running excel in compatibility mode and NL("Sheets"

I was getting this message:

An unexpected error has occurred: Excel cannot insert the sheets into the destination workbook, because it contains fewer rows and columns than the source workbook. To move or copy the data to the destination workbook, you can select the data, and then use the Copy and Paste commands to insert it into the sheets of another workbook.

The problem was that I was saving the Jet Report from a previous version to Excel 2010. Once I save the excel to the current version and open the report "not in compatibility mode" the report ran fine.
